I read the story. I say BULL. The MAYOR is too smart a lady to make such a blatantly STUPID move. You don't have to be a Harvard graduate or a Philadelphia lawyer to know she was within her rights to dismiss him for whatever reason she wanted. Usually that kind of contract states that the employee serves at the will of the employer.
It sort of, kind of was within her right to fire him for political reasons. It's a political job. Makes sense. Handled clumsily,but maybe it will just blow over and MADAME MANGLER can go back to her MUD WRESTLING career.

it the reasons given were all a distraction. Let this PROLIFIC POET PONDER this POINT. GARDY came to public service from a career in SCIENCE. He was a CHEMIST, not a lawyer (Hey in a former life, I was a CHEMISTRY whiz).
Now, I am going to throw a few things out there for you to think about. There is HIGH LEVEL state involvement in the DREIWCZ DISASTER. The HEATING DUCTS have been closed for ten years, then there is the STRAWBERRY BROOK and the GE connection with all those CHEMICALS and the potential ENVIRONMENTAL and HEALTH damage that may have occurred.

there is this. I've heard there are scientific studies out there that put the lead levels in the land on which the INGALLS garden is planted on at extremely dangerous levels. This could put the city in a perilous predicament liability-wise.
LI-A-BIL-ITY, that's a four letter word in lawyer talk. A SCIENTIST would know the dangers of these CHEMICALS and ignorance is bliss as long as nobody finds out. So by eliminating people who might know the dangers, increases the likelihood of avoiding discovery.
If he knew all this, why has he been silent the past 3 years? I don't agree with firing him (Claire was Buzzy's campaign manager and Tim Cahill's campaigner without a problem) but don't start problems for the Food Project that is doing great work - they test regularly and put 3 feet of new soil on the land before planting. The city needs more gardens and throughout all old cities there is lead in the soil from lead paint. If the aide was a scientist he understands that.
ReplyDeleteIf there is no problem, the science will bear it out. Am I understanding you correctly, basically you are saying because there is lead everywhere it is all right? Don't worry about MCAS scores, we need our vegetables.
ReplyDeleteThis is off topic but since we are talking about the mayor I will throw it in....I am still trying to get her and/or her chief of staff to contact me back. I contacted them both regarding the residency requirements for the city. As we all know according to the charter you must be a resident of the city within 6 months of being hired. However, many of our administrators and those on Commercial St are not Lynn residents, yet they are making the decisions for our city and schools (and were even allowed solely by Patti Capano to voice their opinion during the school committee meeting) I know there are exceptions to this rule for some positions, but where is it stated and for which ones? Many people believe the entire school department is waived from this requirement. However, is this actually the case, or is this just assumed because we have so many within the school department who are not residents? Does anyone know anything about this? From the looks of it, I will have to physically visit the mayor's office to find out the information. I thought an email response would be easiest for her, but I guess not.
ReplyDeleteTom gave me the policy for OPEN-MIKE and it clearly states there is a residency requirement, PATTI was probably within her rights as chair, but...

Massachusetts teachers are exempt from residency requirements per their state union. Teachers do not have to live in Lynn - that has nothing to do with the open mike though.
ReplyDeleteI know teachers are exempt, but what about VP's, Principals, and others on Commercial Street? I think Stan's right, I will have to go to the legal department at city hall, unless the mayor decides to email me back??

Deleteper the Item (12/3/10) The residency provision is contained in the city charter, adopted in 1979, but does not apply to schoolteachers, school nurses and administrators, and therapists who hold a professional degree with an associated state license.
ReplyDeleteHowever, it does apply to police officers and firefighters hired after 1979, and to janitors, secretaries and other non-professional School Department employees.
In 2005, then-mayor Edward Clancy Jr. began enforcing the law by having employees submit proof of local residency through tax and utility bills, mortgage statements and other documents.

I did not find any provisions regarding this, but that doesn't mean they're not there.
Lori keep up the good work. You have very good questions with of course no answers. Good luck hearing from the Mayors office. She is never in and when she is, she is playing Wii. Her hit squad in her office are rude, disrespectful and down right "dumb".
